1. Definitions
In these Terms and Conditions:

“CyberFinance” refers to CyberFinance (Pty) Ltd.

“Client” refers to any person using the services of CyberFinance.

“Services” include but are not limited to debt review, debt consolidation, debt counselling, free debt assessments, and related financial advice.
2. Scope of Services
CyberFinance offers financial support services aimed at assisting over-indebted consumers in South Africa.
Our services may include:

Debt review under the National Credit Act (NCA)
-
Debt consolidation planning
-
Negotiation with credit providers
-
Free debt assessments
-
Budgeting support and financial advice
CyberFinance does not offer credit or loans.
3. Eligibility
To qualify for our services, you must:

Be 18 years or older
-
Be a resident of South Africa
-
Have a verifiable source of income
-
Be legally over-indebted or struggling to meet your monthly credit obligations
CyberFinance reserves the right to decline any application that does not meet these requirements.
4. Client Obligations
By using our services, the client agrees to:

Provide accurate and complete personal and financial information

Authorise CyberFinance to communicate with credit providers on their behalf

Comply with all processes and recommendations outlined during the debt review
-
Inform CyberFinance immediately of any changes in income or employment
Failure to comply may result in termination of services.
5. Fees and Payment
CyberFinance follows the fee guidelines set out in the National Credit Regulator (NCR) framework. Fees may include:

An initial assessment fee (if applicable)

A once-off application fee (deducted from the first payment)

Monthly service fees during the debt review process
Clients will be fully informed of all applicable fees prior to entering into a service agreement. No hidden costs will be charged.
6. Confidentiality & Data Protection
CyberFinance complies with the Protection of Personal Information Act (POPIA).
We will:

Treat your data confidentially and store it securely

Only use your information for purposes related to your debt review or financial assistance

Not share your information with third parties without your consent, unless required by law
7. Termination of Services
Either party may terminate the service agreement with written notice.
CyberFinance may terminate services if:

The client provides false information
-
The client fails to cooperate or make agreed payments
-
The client’s financial situation changes significantly without notice
Termination does not affect any obligations incurred prior to termination.
8. Liability
CyberFinance offers services in good faith and according to legal standards. However, we cannot guarantee specific outcomes. CyberFinance is not liable for:

Rejection of proposals by credit providers
-
Legal action taken by creditors outside the debt review process
-
Consequences resulting from misinformation or non-compliance by the client
9. Dispute Resolution
If a dispute arises, the client agrees to first attempt to resolve the matter through direct communication with CyberFinance.
If unresolved, either party may escalate the issue to the National Credit Regulator (NCR) or other relevant authority.
10. Governing Law
These Terms are governed by South African law.
Any legal proceedings shall fall under the jurisdiction of South African courts.
